Terms & Conditions of Employment - Example Two - Word Version


This contract of employment is agreed between the employer __________ and the employee ____________.

I am not under obligation to recognise any former employment of yours as continuous service.

Wages

The normal rate of pay is currently £______ per hour/day/week

Duties of the post

Your duties are described in the job description you were provided with when you applied for this post.

Working hours

You are expected to work a ______ hour shift. The working time may be extended. I will, where possible, agree any extension to the shift with you in advance. You will be paid accordingly.

Your working shift will normally start at _____ am/pm, and end at_____am/pm.

It is important that you are punctual. If you are delayed for more than 15 minutes, please inform me. Do not arrive for work more than 10 minutes early unless specifically requested by me to do so.

If necessary, due to unexpected circumstances, you must agree to prolong your shift. You will be paid for this. There are no specific times for breaks. Arrangements for breaks will be dictated by the events of the day. I will endeavour to be as flexible as circumstances allow.

You may be asked occasionally to work extra hours in the event of other staff being absent because of illness, leave or holidays. I will provide as much notice as possible. You will receive payment in respect of extra hours worked.

Holidays

You are entitled to 5.6 weeks holiday per year based on full time hours. Part-time employees are entitled to the equivalent on a pro rata basis. The holiday year is based on a financial year (1 April to 31 March inclusive). You may not normally take any leave within the first six months of your employment, unless agreed with me prior to your commencement date.

Bank Holidays & Public Holidays

You are required to work bank and public holidays if they happen to fall on the days that you are due to work. You may take leave on these days by prior arrangement, provided that they are part of your 5.6 weeks leave entitlement.

Sickness & Maternity Pay

Your entitlement to Sickness and Maternity Pay is in accordance with statutory provisions.

Probationary Period

There will be a probationary (trial) period lasting six months, during which time the employer or the employee may terminate the contract of employment I reserve the right to extend the probationary period, should I deem it necessary.

Should you prove unsuitable for the post, I reserve the right to pay you one week’s wages rather than require you to work your notice.

Should gross misconduct (theft, threatening behaviour or wilful damage) on your part occur, you will be dismissed immediately.

Conduct

As your main place of work is my home, I expect a reasonable attitude towards your responsibilities during working hours.

You are asked to:

  • Respect confidentiality and privacy.
  • Perform the tasks detailed in your job description.
  • Notify me as early as possible if you are unable to work.
  • Provide a telephone number where you can be contacted.
  • Be able to travel to work independently.

You are asked not to:

  • Use my property without my consent.
  • Bring anyone (including children) to my home without asking me.
  • Bring pets or other animals to my home.
  • Smoke inside my home.

Staff Training

I will train you in the specific requirements of the post, during the probationary period and beyond. We are jointly responsible for identifying any further training needs that you may have.

Period of notice

On successful completion of the probationary period, notice of the termination of employment will be in writing.

One week’s notice will be given to you if you have been continuously employed for a period not more than two years.

If you have over two years standing will be entitled to one week’s notice for each year you have been employed. The maximum length of notice will be twelve weeks.

I have the discretionary power to pay basic salary in lieu of notice as an alternative to the your working your notice.

I reserve the right to terminate the contract of employment immediately in the event of gross misconduct (theft or threatening behaviour) on the part of the employee.

Terminating the contract

Either party may terminate this contract as long as the required notice has been given. You are required to provide four weeks notice of your intention to leave the post.

Disciplinary Procedure

If I am considering taking disciplinary action against you or dismissing you for any other reason than gross misconduct, I will inform you in writing. I will provide reasons for the action.

I will arrange a meeting with you to give us both the opportunity to discuss the action and the reason for it. I will provide all relevant information to you in advance of the meeting. You have the right to be accompanied by a work colleague or individual approved by a Trade Union to this or subsequent meeting.

If you are dissatisfied with any decision that I make at the meeting, you are legally entitled to request an appeal which should be lodged within five working days. I will arrange to meet with you within a reasonable timescale.

I will endeavour to make you aware of my decision as promptly as I am able to.
I reserve the right to suspend you on full pay pending any investigation into an alleged incident.

The stages of the Disciplinary Procedure are as follows.

• Recorded oral warning (expires after six months)

• Written warning (expires after nine months)

• Final written warning (expires after twelve months)

• Termination of contract of employment.

Grievance Procedure

I will endeavour to address any grievance brought to my attention by you, by means of negotiation. If this informal approach fails, it is your responsibility to give me a written explanation of any grievance that you have in relation to working for me.

On receipt of your grievance in writing, I will arrange to meet you to discuss the issue or issues that you have raised. After the meeting, I will advise you of my decision in relation to your grievance.

If you are not satisfied with my decision, you may request an appeal within five working days. I will arrange to hear your appeal at a mutually suitable time and venue. After the appeal, I will let you know my final decision.

Pension

There are no pension arrangements attached to this post. You may make your own arrangements in respect of pensions.
